30-day notice to vacate

A notice to vacate is how a landlord ends a month-to-month tenancy without blaming the tenant for a lease violation. People often search for a 30-day eviction notice, but the document that ends a no-cause tenancy is a notice to vacate. It is not an eviction for cause, and it does not require the tenant to have done anything wrong. It sets a date when the tenancy ends and the tenant must move out.

Most states call for 30 days, which is why the search term is usually 30-day notice to vacate. Some states require 60 days, and a few require more after a tenant has lived in the unit for a year or two. The correct period depends on the state, the length of the tenancy and sometimes the city.

30-day notice to vacate

STATE OF FLORIDA

This notice to vacate is given on October 20, 2026 by Cedar & Vine Properties LLC, of 1200 Coral Way, Suite 4, Miami, FL 33145 (the landlord), to Luis A. Herrera (the tenant), for the premises at 455 SW 22nd Avenue, Unit 2, Miami, FL 33135, in Miami-Dade County, State of Florida. The tenancy is governed by the lease dated September 1, 2024 and by the laws of the State of Florida.

1. Notice to end the tenancy

You are hereby notified that the tenancy of the premises will end on November 30, 2026. This notice is given at least 30 days before that date. No new term will begin, and you must vacate and surrender possession of the premises on or before the end date.

2. Reason for the notice

The reason for this notice is that the owner is ending the month-to-month tenancy. This notice is not a claim that you breached the lease. If state or local law requires a specific reason or a specific form for ending a tenancy, the landlord will comply with that requirement before the end date.

3. Move-out

On or before the end date, remove your personal property, leave the premises in the condition required by the lease, and return all keys, access cards and garage openers. The landlord will inspect the unit after you leave. Move-out instructions: Leave all keys on the kitchen counter and email a forwarding address. The unit will be inspected on December 1..

4. Security deposit

The security deposit will be handled under the law of the State of Florida after you move out and the landlord inspects the unit. Send your forwarding address to 1200 Coral Way, Suite 4, Miami, FL 33145 so the deposit and an itemized statement of any deductions can be sent to you.

5. If you remain after the end date

If you remain in possession after November 30, 2026, the landlord may file an action for possession under state law. The landlord may also seek rent for the time you remain and any other remedy the lease or the law allows. The landlord will not use self-help, change the locks or remove your property without a court order.

6. Certificate of service

I served this notice on October 20, 2026 by personal delivery. I am at least 18 years old and I am not the tenant. A copy of this notice and any mailing receipt are kept in the landlord's file.

7. Governing law

This notice is given under the laws of the State of Florida and any local ordinance that applies to the premises. If a court finds that the notice period or service method does not meet the law, the landlord may serve a corrected notice. Nothing in this notice waives a right the tenant has under the lease or under state or local law.

Step 1 of 3

Parties and property

The notice period has a legal minimum. Choose the period your state statute requires, and keep proof of the date you served it.

What the form includes

Parties and premises

Landlord, tenant and the full rental address, with the county named.

End date

The date the tenancy ends, with a plain statement that no new term will start.

Reason

A choice of common reasons, or a blank statement that no cause is alleged.

Move-out instructions

Keys, forwarding address and the address for the security deposit.

Deposit note

A reminder that the deposit will be handled under state law after move-out and inspection.

Proof of service

The date, method and signature of the person who delivered the notice.

After you sign

Serve it within the window

The notice period usually runs from the date of service to the end date, and some states require it to end on the rent due date. Count the days before you sign, and serve early rather than late.

Use a method you can prove

Personal delivery, posting and mailing, or certified mail, depending on the state. Keep the receipt, a photo and a written record of the date and time. A notice that cannot be proven is hard to rely on in court.

Do not accept rent for a new period

Accepting rent after the termination date can create a new tenancy in some states. If the tenant stays, talk to a local attorney before accepting money or signing a new lease.

Handle the deposit by the statute

Most states set a deadline for returning the deposit and an itemized statement of deductions. Use the address the tenant gives you, and keep proof of mailing. The notice is the start of that process, not the end.

Questions people ask

How many days notice do I need to give?

Most states require 30 days for a month-to-month tenancy. Some require 60 days, and a few require 60 or 90 after the tenant has lived there a year or more. The builder shows the period for your state and cites the statute.

Is a 30-day eviction notice the same as a notice to vacate?

A 30-day eviction notice is the search term many landlords use for this document. The legal name is a notice to vacate or a notice of termination. It ends a month-to-month tenancy; it is not a court order and it does not remove the tenant. If the tenant stays, the landlord still has to file an eviction case.

Can I end a fixed-term lease with this notice?

No. A fixed-term lease ends on its own date unless the tenant breaches it or the lease allows early termination. This notice is for a month-to-month tenancy or a tenancy that has become month-to-month after the lease expired.

Do I need a reason to end a month-to-month tenancy?

In many states, no reason is required for a month-to-month termination. Some cities with just-cause rules require a listed reason, and some states restrict retaliation. Check the local ordinance before serving a no-cause notice.

What if the tenant refuses to leave?

A notice to vacate does not remove the tenant. If the tenant stays past the end date, the landlord must file the unlawful detainer or eviction case the state provides. Do not change the locks or remove belongings without a court order.

Does this notice affect the security deposit?

The deposit is handled after the tenant moves out, under the state's deposit statute. The notice can remind the tenant of the forwarding address and the inspection process, but it does not decide what is withheld.
